Prof Davies successfully represents Pakistan International Airline Corp in major contract law case

The Supreme Court has delivered its judgement on economic duress in Times Travel (UK) Limited v Pakistan International Airlines Corporation.

On 18 August 2021, the Supreme Court handed down its long-awaited judgment on economic duress in Times Travel (UK) Limited v Pakistan International Airlines Corp

This is a significant decision on a key topic in contract law. The Supreme Court clarified the elements of economic duress, and recognised that 鈥渓awful act economic duress鈥 might, in rare instances, render a contract voidable. However, lawful act duress could not, on any view, be established on the facts of the case, and there was disagreement between the Justices regarding what needs to be shown for a claim for lawful act economic duress to succeed.听
